Flight cancellation due to the fault of the airport. To whom to file a claim and is it possible to receive compensation?
Due to the emergency with the Belavia aircraft, from midnight on July 13, Zhuliany airport canceled night flights. They said about the morning ones that they were delayed. So, a flight at 10:20 to Nuremberg was promised at 13:00, and as a result, at 14:00, Wizzair sent an SMS about the cancellation of the flight. It is clear that the airline will return the money for the tickets, but the payment for the hotel and moving around Europe burned down with a blue flame. (Booking was contacted, they contacted the hotel, which refused to make a refund.)
The most disgusting thing about the situation is that people were not provided with any information during the day, only: "Wait. The airport is closed until 12, and then until 15 o'clock."
Wrote a post on FB. Pan Omelyan replied that the airport was private and they could not influence it.
What else to do and how to get compensation from Zhulyan?

What is an emergency? I think that the situation is more related to force majeure. Moreover, the money will be returned to you for the ticket, and everything else is force majeure, you say no compensation?
аватар Bovik
There is only one way, through the court.
But...
What will be the amount of the claim?
a) a small amount, the court does not consider at all (the amount is determined by the Law);
b) more than a).
Then, firstly, write a letter of complaint to the company.
After receiving the answer, understand your chances of winning.
And, of course, if it's force majeure, the chances of winning are zero.

I found information about what happened and I’ll say that this situation refers to force majeure, because in connection with the accident, subsequent flights were canceled until all the consequences were eliminated. I will say right away that the cost part of claims through the court will be incomparable with your losses and the chances of winning and, accordingly, recovering them are practically zero (to claim that they are equal to zero, you still need to study the documents thoroughly).

zhdanova10, so why then your question. If you have had similar precedents and you were able to solve them in your favor, decide. Good luck

One head is good, but the knowledge and experience of other people is much better)

Personally, my experience (there were two situations with delays). settled without compensation. The first time when my daughter flew to Munich through Turkey, and an attempted military coup had just begun in Turkey (July 2016), it was a force majeure, but they fed, they provided communication to inform her relatives that she was alive and was sent to Munich on the very first flight. And the second time my husband and I got stuck in Thailand, they collected signatures, sued, but alas, charters (and this is written in the tickets) have the right to a lot, including delays. Fed, watered and that's enough for you.

I think your claim is unfounded. Those passengers who were supposed to fly out after 24 hours, they managed, as I understand it, to fly out at 14 days and later. This is a flight delay, if a charter, then it is allowed. If a regular, flight board, on schedule, then the disruption of the flight due to force majeure. Litigation with the airline, and that, in turn, will sue the airport ... for the loss of a passenger that occurred as a result of a flight disruption (loss of hotel reservations, some cheap transfers, etc.). Litigation for an individual will, as they say, "not worth the candle" ...

And this is all about refunding the cost of tickets, but not the cost of hotels at a non-refundable rate.

Pack, I think so too. The author of the question is sure that the airline will refund the cost of the ticket (this is in her question). We are talking about damage to hotel reservations on websites, payment for transfers, etc. at the location...
I think the airline simply will not accept such claims ...
аватар zhdanova10
Colleagues, the issue with the return of money for the ticket has been resolved.
Wizzair immediately offered two options (money to a card or to a bonus account).
We are talking about additional compensation (hotels and transfers, that is, which can be proven). Plus moral damage!
From experience, often the claim is actually satisfied after the appeal, sometimes - later. But neither my relatives nor friends have ever reached the court)))
Let's try)

Can I ask you to unsubscribe later on the results? Thanks!

zhdanova10 "We are talking about additional compensation (hotels and transfers, that is, what can be proven). Plus moral damage!"
This is what I think is not very promising. After all, we are talking about a court case with the airline, through whose fault the event occurred (your material losses). But the airline had objective reasons (force majeure), independent of the airline. At the airport, where there was a congestion on the runway, too (force majeure - problems with the Belavia aircraft). Thus, a whole chain of causes is obtained. It is one thing when such a claim is collective and is conducted by a whole army of lawyers, it is quite another thing to conduct cases yourself ...

zhdanova10, believe the experience, no way!
The airline will refund the money for the tickets and that's it. Claims, especially not collective, to the airport is a disastrous, tedious business.

Look in advance in the registry to see if there were similar cases and how they ended. If you are satisfied, then you can try. Good luck

The passenger has "business" with the airline, not with the airport. The money was returned for the canceled flight. And what chain goes on there (broken reservations, cars, routes .. moral losses) - is this to whom to present?
аватар moy_contakt
In this situation, everyone suffered losses - the airport, air carriers, passengers .... this sometimes happens. Accept what happened and move on.
аватар zhdanova10
Guys, it's not the money that matters here!
It's just a way of reminding the airport (and the airline) that every seat is a human being. And you can not treat people like inanimate objects!
People came to the airport and did not know what to expect. Complete obscurity and indifference. No information. Flights were delayed and delayed. Some of them were sent to Boryspil after 6-8 hours, and it is still unknown when they took off from there. Wizzy, as I understand it, could not agree. Seven hours after the expected departure, writing about the cancellation of the flight is disgusting!
Therefore, the question arose!
Here is the airport branch:

zhdanova10 I agree with you
but this is life, force majeure happens that does not depend on airlines, airports, etc.
remember the cases when airport employees go on strike and airlines suffer huge losses, and passengers "hang out" at airports, then who should make claims?
Or when there was a volcanic eruption, some airports were closed and thousands of trips were disrupted.
Thank God no one was hurt in the incident.
аватар moy_contakt
Pig, I agree. But in general, what is the situation with air transportation - they wanted to transfer it, it didn’t work out, they didn’t fly. They don’t always give water, and when they arrive, they poke a ticket where it says that the air carrier has the right .... and he has the right to have us in all directions and no one orders him, especially charters. how many people are sitting at airports and in the case of a charter, it is not realistic to receive any compensation at all, because they have the right to do so. And no matter how much you write, don’t complain, don’t file a lawsuit ... and the situation just won’t change. The same vizzeir, if this situation had happened in Europe, I’m sure that everything would have been different, but in Ukraine you can ignore people, they will be patient and will continue to fly.
