TUI is the worst operator in the world!
Good afternoon, dear forum users.
I want to share with you about the sore. A month and a half ago, we booked a tour to Egypt through the TUI tour operator in Kyiv. Three weeks after booking and, accordingly, payment, the tour operator announced that he could not send us to the selected hotel from January 7 (the date of the original booking), but offered us to fly on January 21. Of course, this was an unpleasant surprise for us, since it’s impossible to fly to these even because of work. The operator agreed to return the money to us in full in my name (one of 2 tourists). For almost two weeks we have been waiting for the transfer of money for the tour. The money has not been returned yet. And last night they said that you need to open an account for a tourist whose name is in the spine about paying for the tour through the bank, otherwise they will not be able to return the money. And last night they said that you need to open an account for a tourist whose name is in the spine about paying for the tour through the bank, otherwise they will not be able to return the money. (that is, to my boyfriend) The question arises: why was it necessary to have 2! weeks to promise to transfer money every day, and at the end of the year, when all the banks are no longer working, to force us to open a new bank account? ... And nothing can be done. There is no contract with the tour operator, because there is no way to prove or recover something..

How is it that there is no contract?
аватар irishka82
After confirming the hotel reservation, the travel agency is obliged to conclude an agreement with you for the purchase of a tourist product. Why did you give them money?
аватар Yaroslavas
There is no agreement with the tour operator. The contract is concluded with the travel agency. They are trying to help in this situation, but so far to no avail...
аватар irishka82
The main thing is that you have an agreement with a travel agency in your hands. It spells out what services and how much you receive.

It seems to me that your travel agency is obscure, usually no one transfers money to anyone, but simply offsets occur due to subsequent bookings, well, except that this is a single booking of an agency with this tour operator .. and this is already suggestive.
but about the work of a travel agency with a tour operator without a contract, this is generally out of the way.

1. Tour operators do not work with travel agencies without a contract.
2. The tourist concludes an agreement with a travel agency, which is an agent of the tour operator and signs the agreement on behalf and on behalf of the tour operator. If you have some other contract with the agency (where the tour operator is not indicated), then this is not a legitimate contract. You should figure out who is to blame for the TUI or the travel agency.
3. The tour operator confirms or does not confirm the tour within 1-2 days. Did you see the booking confirmation from TUI on January 07 or were you only verbally told that the hotel was confirmed?

Yes, something is clear here, that the matter is dark, the agency is probably darkening.

One hundred percent! The agency decided to "play" with the inexperienced. You need to shake the TA who was paid money. What do you have on hand?
аватар hatinka
Write a complaint in writing to both, I advise you to completely switch to written official correspondence. Distracts many. True, it takes a lot of time. But since you're not flying anywhere, it looks like you have it.
And also, check your TA at least EDRPOU - is it in a closed state.
Now a lot of sole proprietorships / PPs are closing, we have recently encountered a small-scale scammer (a completely different area).
Happy holidays! Hope everything ends well for you!

To write a claim for this you need to have a basis. The basis is a legally correctly executed contract, which, as I believe, YaroslavaSh does not have. The experience of "Karia" was not a lesson for everyone, as I see it.

In continuation of the topic.
Dear tourists, contact those travel agencies in your city that work in the legal field, and not those that offer the biggest discounts.

I want to be clear. I have been traveling with this travel agency for the eleventh time (Turkey, Czech Republic, Malta, Germany, Hungary, Poland, Austria, etc.) and my good friend works in it, so I immediately dismiss any options that the travel agency wants to cheat us as impossible. I saw the confirmation of the reservation personally, but after three weeks the respected tour operator TUI canceled it. On what basis this happened is not at all clear. They didn't even explain the reason to my travel agency. They just put us before the fact - either we fly on January 21, or they return the money to us. I may have been a bit vague about the contract. Of course, there is an agreement, but, like any tourist, I conclude an agreement with a travel agency. I also personally saw the documents on payment to the tour operator, therefore I understand that it is inappropriate to demand these funds from my agency, since they are now with the tour operator. Today they promised to transfer the money to the account on January 4th.
Let's hope and wait ... Well, thanks to my travel agency, which quickly responded and we managed to book a tour for the same January 7, but in a different hotel. So all the same God forbid everything will end well. But I’m sure that next time I will specify the tour operator and I won’t go with this

"..I understand that it is inappropriate to demand these funds from my agency, since they are now with the tour operator..."
In any case, it is appropriate for you to demand money from the one to whom you paid them. What TA did with them next, you should not be sad at all. Having a girlfriend at the agency is only a plus (hopefully) to get your hard-earned money back. Further actions of TA to resolve issues with TUI are not your concern. Take your money, or seek to be credited to the payment for the newly booked hotel and rest easy. The rest is up to your friend.

And yes, by the way, this morning we had to urgently open an account in the name of a guy so that the tour operator would transfer money there. They refused to transfer funds to my account.
аватар jabetta
In general, to be honest, some kind of crazy situation, and in everything. And this is not clear at all:
"They flatly refused to transfer funds to my account"
It was they (THAT) who personally told you (the motivation is not clear - what's the difference, whose account, etc.)? Who do you communicate with directly? I have a strong feeling that you are being led by the nose (excuse me).
аватар Yaroslavas
This was the case: I brought cash to the travel agency after confirming the hotel. With me, a representative of the travel agency went down to the bank and paid the tour operator with a note for what, which tour and to whom the money was transferred. In the field "payer" along the way, the girls indicated my boyfriend, that is, he is the official payer, and not me. That is why they want to return the money only by bank transfer and only to the one who "really" paid for it. This is how the tour operator motivates his actions ...
аватар Yaroslavas
although, as for me, it's also nonsense))
аватар Yaroslavas
There is one small, but important difference: in Germany, Germans work at TUI, and ours work at TUI. Still, people create the company's image, and not anything else. Mentality is a stubborn thing...
аватар NatashaS
Based on the foregoing, the travel agency paid the TUI on behalf of the tourist, but the tourist has a certain contract with the travel agency, and not with the tour operator. It was the booking of tours according to this scheme that led to a very large number of tourists who suffered from the bankruptcy of Kariya. With such a scheme, a tourist generally falls out of the legal field. He has an invalid contract with a travel agency, and for a tour operator he is nobody.
аватар NatashaS
And the fact that TUI returns the money to the one who paid is natural. TUI is a legal entity where all calculations go through the accounting department, which has the right to return money only to the one who paid. If the agency booked the tour legally, then the money would be returned to the agency, and then to the tourist with whom the contract was signed.
аватар Lina23S
Good TA insured themselves at the expense of the tourist. YaroslavaS I hope you now understand that this nice agency simply reinsured itself at your expense, because they had to transfer money on their own behalf and be responsible as intermediaries, and now they seem to have nothing to do with it and it’s not for them to disentangle.
аватар alex45
And again, you need to read the contracts, and not just sign them! The low legal culture of our people!
аватар Lina23S
Alex45 fully agrees, I myself am always amazed at how people sign legal documents, contracts without even reading what is there, and then the deplorable results of carelessness.
аватар jabetta
In this case, the HARDWARE relied on a friend, and that's the result.
аватар maldo61
So the payer is a tourist? And why then print the payment agency at all? Maybe because of the commission?
аватар Lina23S
Well Duc, of course, because of the commission, why else, and the money was cut down from the tourist and there was no responsibility, very convenient.
аватар maldo61
In general, in fairness, it would be necessary to voice the name of the agency, well, so as not to inadvertently use its services.
аватар jabetta
So the TS firmly believes that TO is to blame, and the agency is white and fluffy.
аватар Lina23S
I think this agency is not an isolated case, unfortunately.
